Website Terms of Use
Effective date: August 13, 2026
These Website Terms of Use (“Terms”) govern your access to and use of truwebz.ca (the “Website”), operated by TruWebz Studios Inc. (“TruWebz,” “we,” “us,” or “our”). By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
1. About This Website
The Website provides general information about TruWebz, our web design, WordPress development, SEO, branding, digital marketing, e-commerce, AI, automation, hosting, maintenance, and related services. It may also include articles, examples, tools, application forms, pricing information, and educational material.
Website content is provided for general informational and promotional purposes. It is not professional legal, accounting, tax, financial, medical, cybersecurity, accessibility-compliance, or regulatory advice.
2. No Client Relationship Through Website Use
Viewing the Website, submitting a form, applying for an offer, requesting a consultation, or receiving an initial response does not create a client, agency, fiduciary, partnership, employment, or other professional relationship.
A service relationship begins only when the applicable parties have agreed to a written scope, contract, proposal, order, or other written confirmation and any required payment or onboarding conditions have been satisfied.
3. Quotes, Pricing, Timelines, and Availability
Prices, market ranges, packages, timelines, examples, and descriptions published on the Website are general information unless expressly stated to be a binding offer. Actual pricing and timing depend on scope, content, integrations, licences, third-party services, approvals, technical requirements, taxes, and other project circumstances.
A quote, proposal, or offer may be subject to an expiry date, eligibility review, availability, written approval, deposit, recurring charges, external costs, or other stated conditions. Applicable taxes may be added unless expressly stated otherwise.
We may correct errors, update information, change or withdraw an offer, or decline a project before a binding written agreement is formed. Nothing in these Terms permits TruWebz to disregard obligations arising under an existing signed agreement or applicable law.
4. Free Website Offer
The TruWebz free one-page website offer applies only to an eligible, approved one-page design and development scope. Eligibility, availability, technical suitability, content readiness, acceptable-use considerations, approved scope, and written confirmation apply.
Unless a written agreement expressly says otherwise:
- the approved one-page website design and development fee is $0;
- client-paid hosting is required to keep the website online;
- domain registration and renewal, business email, premium software, paid media, messaging, and third-party services are separate;
- additional pages, e-commerce, booking, advanced forms, integrations, custom functionality, ongoing SEO, maintenance, migration, and other work require a separate paid scope;
- not every applicant will qualify; and
- submission of an application does not guarantee acceptance or project commencement.
Ownership, licences, hosting, migration, cancellation, support, revisions, content responsibilities, and other project-specific terms will be set out in the written agreement or confirmation for an approved project.
5. No Performance Guarantees
TruWebz may design and implement strategies intended to support usability, accessibility, visibility, enquiries, conversions, efficiency, or growth. However, unless expressly included in a signed written guarantee, we do not guarantee:
- search-engine rankings, indexing, map placement, traffic, backlinks, or algorithm treatment;
- leads, calls, enquiries, conversions, sales, revenue, profit, return on investment, or business growth;
- advertising approval, cost, reach, impressions, or campaign results;
- AI or automation output accuracy, completeness, availability, or uninterrupted operation;
- complete security, error-free operation, accessibility or regulatory compliance; or
- availability or continued features of a third-party platform, plugin, API, hosting provider, search engine, social network, or software service.
Results depend on many factors outside our control, including your market, competition, location, offer, pricing, reputation, content, approvals, budget, responsiveness, follow-up, third-party systems, algorithms, and ongoing investment.
6. Articles and Educational Content
Articles and resources may discuss pricing, marketing, SEO, technology, AI, laws, standards, or business practices. Information can become outdated and may not apply to your circumstances. Examples and price ranges are illustrative estimates rather than quotations, industry standards, or guarantees.
You are responsible for obtaining appropriate professional advice before relying on information for a legal, financial, tax, medical, security, accessibility, regulatory, or other high-impact decision.
7. Accuracy and Website Changes
We try to keep Website information useful and accurate, but we do not promise that every item is complete, current, error-free, or suitable for every purpose. We may change, correct, suspend, or remove Website content or features at any time, subject to applicable law and existing contractual obligations.
8. Your Submissions and Responsibilities
When submitting information through the Website, you agree that:
- the information is accurate and you are authorized to provide it;
- you will not provide passwords, payment-card details, government identifiers, health records, tax files, confidential client records, or other sensitive information through a general inquiry form;
- your submission will not infringe another person’s copyright, trademark, privacy, confidentiality, publicity, or other rights;
- you will not submit unlawful, defamatory, deceptive, discriminatory, malicious, or harmful material; and
- you will not use a form to send spam, malware, automated abuse, or unauthorized solicitations.
You retain ownership of materials you submit. You grant TruWebz a limited permission to access, review, reproduce, and use those materials as reasonably necessary to evaluate your inquiry, communicate with you, prepare a proposal, or provide an authorized service. Project agreements may include additional licence and ownership terms.
9. Acceptable Use
You may not:
- use the Website for an unlawful, fraudulent, deceptive, abusive, or harmful purpose;
- attempt to gain unauthorized access to accounts, systems, data, code, or restricted areas;
- introduce malware, harmful code, denial-of-service activity, or unreasonable automated traffic;
- scrape, harvest, or collect personal information or Website content in violation of law or these Terms;
- interfere with Website security, operation, forms, analytics, or other users;
- impersonate another person or misrepresent your authority or affiliation;
- copy, resell, frame, mirror, or commercially exploit substantial Website content without permission; or
- use TruWebz branding, content, or systems to create a false impression of endorsement, authorization, or affiliation.
10. Intellectual Property
The Website and its original text, branding, graphics, layouts, code, illustrations, videos, downloads, and other content are owned by or licensed to TruWebz and are protected by applicable intellectual-property laws.
You may view and print a reasonable amount of Website content for your internal, non-commercial evaluation of TruWebz services. No other right or licence is granted. You may not reproduce, modify, distribute, publish, sell, sublicense, or create derivative works from protected Website content without prior written permission, except as permitted by law.
Third-party names, trademarks, products, and services belong to their respective owners. Reference to a third party does not imply sponsorship, endorsement, or affiliation unless expressly stated.
11. Portfolio, Examples, and Testimonials
Portfolio work, mockups, concepts, demonstrations, case examples, and testimonials are presented for context and may not represent the exact scope or outcome of another project. Results vary.
Third-party logos, screenshots, names, or materials remain subject to the rights of their owners. If you believe material has been used improperly, contact us at truwebzstudiosinc@gmail.com.
12. Third-Party Links and Services
The Website may link to or interact with third-party websites, plugins, hosting services, payment services, analytics, social networks, AI providers, or other platforms. TruWebz does not control and is not responsible for their content, security, privacy practices, availability, pricing, terms, or actions.
Your use of a third-party service is governed by that provider’s terms. Review them before creating an account, submitting information, installing software, or making a payment.
13. AI-Generated or AI-Assisted Information
Some Website or service-related material may be prepared with AI-assisted tools and human review. AI systems can produce incomplete, outdated, biased, or incorrect output. Website content should not be treated as a substitute for professional advice or independent verification.
Project-specific responsibilities for AI inputs, outputs, approvals, data handling, monitoring, and human review will be addressed in the applicable written scope or agreement.
14. Privacy
Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy. By submitting information, you acknowledge that you have reviewed that policy.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis. TruWebz disclaims warranties and conditions not expressly stated in these Terms, including implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation.
Some jurisdictions do not permit certain exclusions. In those jurisdictions, exclusions apply only to the extent legally permitted.
16. Limitation of Liability
To the maximum extent permitted by applicable law, TruWebz and its directors, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or connected with use of, inability to use, or reliance on the Website or its general content, including lost profits, revenue, data, opportunities, goodwill, or business interruption.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Liability arising from paid services is governed by the applicable service agreement, not solely by these Website Terms.
17. Indemnity
To the extent permitted by law, you agree to be responsible for reasonable losses, claims, costs, or expenses arising from your unlawful use of the Website, violation of these Terms, infringement of another person’s rights, or material you submit without authority. This section does not apply to the extent a loss was caused by TruWebz’s own unlawful conduct.
18. Suspension and Enforcement
We may restrict or block access, reject a submission, or take reasonable protective action where we believe Website use is unlawful, abusive, insecure, fraudulent, or contrary to these Terms. We may cooperate with lawful investigations and preserve relevant records as permitted or required by law.
19. Governing Law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. Subject to mandatory consumer-protection or jurisdictional rights that may apply, disputes relating to the Website will be submitted to the courts located in Ontario, Canada.
20. Changes to These Terms
We may update these Terms when the Website, our practices, or legal requirements change. The updated version will be posted on this page with a revised effective date. Your continued use of the Website after an update means you accept the revised Terms, to the extent permitted by law.
21. Severability and Entire Terms
If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect, and the affected provision will be interpreted or limited to the minimum extent necessary to make it enforceable where permitted.
These Terms and the Privacy Policy form the agreement concerning general use of the Website. A signed service agreement, proposal, order, or written offer confirmation controls if it conflicts with these Terms regarding a specific service.
